HENRY-BOWLES, INC Event Terms & Conditions
(Applies to All Events, Including Hollydays Market, Autumn Acres, Spring Market, and Home for the Holidays Gift Market) Last Updated: May 22, 2025
1. Acceptance of Terms
By purchasing a ticket OR attending any event hosted by HENRY-BOWLES, INC (hereafter referred to as “Organizer”), including but not limited to Hollydays Market, Autumn Acres, Spring Market, and Home for the Holidays Gift Market, the ticket holder (“Attendee”) acknowledges and agrees to all terms and conditions outlined in this agreement. A physical or digital signature is NOT required for this waiver to be effective. Attendance at any event constitutes full acceptance of these terms.
2. Ticket Purchase & Refunds
- All ticket sales are final. No refunds or exchanges unless the event is canceled by the Organizer.
- Tickets are non-transferable and may not be resold for profit.
3. Assumption of Risk & Release of Liability
- Attendee assumes all risks related to participation, including but not limited to trip and fall hazards, crowd congestion, interactions with vendors, venue conditions, and public spaces.
- The Organizer, venue owners, vendors, and affiliates are not liable for injuries, damages, or losses incurred at any event, whether indoors or outdoors, in a booth, aisleway, common area, parking lot, or any other event space.
- This waiver explicitly releases the Organizer from liability, including claims of negligence related to venue conditions, vendor interactions, and general event attendance.
4. Force Majeure (Event Cancellation & Unforeseen Circumstances)
- The Organizer reserves the right to cancel or reschedule events due to circumstances beyond our control, including but not limited to inclement weather, venue restrictions, government mandates, or unforeseen operational challenges.
- No refunds will be issued unless explicitly stated by the Organizer.
5. Personal Belongings Disclaimer
- Attendees are solely responsible for their personal belongings. The Organizer is not liable for any lost, stolen, or damaged items at the event.
6. Vendor & Third-Party Interactions
- Vendors at Organizer events operate independently, and the Organizer is not responsible for any transactions, disputes, or issues arising from vendor interactions.
7. Alcohol & Substance Disclaimer
- If alcohol is available at any Organizer events, attendees must comply with all applicable laws.
- The Organizer is not responsible for any incidents arising from alcohol consumption or substance use at the event.
- Any attendee found violating alcohol or substance policies may be removed from the event without refund.
8. Photography & Media Release
- Attendees acknowledge that event staff may take photographs or video for promotional purposes.
- By attending, the Attendee grants permission for their image to be used without compensation.
9. Event Code of Conduct
- Attendees must treat vendors, staff, and fellow shoppers with respect.
- Disruptive behavior or failure to adhere to event policies may result in removal without refund.
10. Governing Law & Dispute Resolution
- These Terms & Conditions are governed by the laws of the State of Texas.
- Any disputes arising from this agreement must be resolved through binding arbitration and may not be pursued in court or through a jury trial.
- Arbitration will take place in Texas, and the arbitrator’s decision will be final and binding. Each party is responsible for its own arbitration costs unless required otherwise by law.
